Terms of Use

Rebel Networks has a responsibility to protect each client and to provide the best services available. The following guidelines were designed to ensure these obligations are met.

Content:
All services provided may be used for lawful purposes only.  Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law as well as any Canadian Federal, Provincial, or municipal law is prohibited.  This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute.  The subscriber agrees to indemnify and hold us harmless from any claims resulting from the use of the service which damages the subscriber or any other party. Pornography and sex-related merchandising is prohibited on all our servers.  This includes sites that may infer sexual content, or links to adult content elsewhere.  We will be the sole arbiter in determining violations of this provision. Also prohibited are sites that promote any illegal activity or present content that may be damaging to our servers or any other server on the internet.  Links to such materials are also prohibited. Any sites that promote or support illegal activity, offensive material, hate related actions, crimes or subject matter.  Links to such materials are also prohibited.

Examples of unacceptable content or links:

Rebel Networks, will be the sole arbiter as to what constitutes a violation of this provision.  Any violation may result in immediate suspension of site until removal of material and files or possible termination of contract without a refund.

Commercial Advertising - Banner Advertising on Site:
Please be assured, we will never impose forced advertising on any domain hosted by rebelnetworks.com.

Commercial Advertising - Email:
Spamming, or the sending of unsolicited email, from our server or using an email address or domain that is maintained on our machine as reference is STRICTLY prohibited.  We will be the sole arbiter as to what constitutes a violation of this provision.

Background Running Programs
We may allow programs to run continually in the background.  These are considered on a case-by-case basis and an extra charge will be incurred based on system resources used and operational maintenance needed.

IRC
We currently do not allow IRC or IRC bots to be operated on our servers.  If an account is found to be using an IRC or IRC bots the account will be deleted from the Rebel Networks Network. 

Server Abuse:
Any attempt to undermine or cause harm to a server, or customer is strictly prohibited.

Refusal of Service:
We reserve the right to refuse, cancel, or suspend service at our sole discretion.  We are committed to running a clean orientated environment.  We do not and will not allow any content that has to do with nudity, pornography, illegal activities, software piracy, profanity, or anything else that would be offensive in any manner.  If a domain that is hosted by Rebel Networks, is found to be indulging in such activities, we will shutdown the domain without notice and will not provide any monies or refunds. All Sub-Networks, Resellers, distributive hosting sites and dedicated servers must adhere to the above policies.

Limitation of Liability:
Rebel Networks shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from Rebel Networks's servers going off-line or being unavailable for any reason whatsoever.  Further, Rebel Networks shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of Rebel Networks’s servers.  All damages shall be limited to the immediate termination of service. Rebel Networks shall be the sole arbiter of what is and is not a violation of these acceptable use policies. Rebel Networks reserves the right to terminate an account at any time and for any reason that causes harm to any Rebel Networks customer's web sites.  Rebel Networks reserves the right to delete all content and files upon termination.  Rebel Networks reserves the right to withhold any pre-paid funds for any site removed for violations of these policies.  Rebel Networks reserves the right to refuse, cancel, or suspend service at our sole discretion. Rebel Networks is not responsible for any damages or orders lost for e-commerce sites due to suspension of service or server down time.

Rebel Networks reserves the right to change these Policies without prior notice or warning.  Non-enforcement of any part of these Policies does not constitute consent.

General Billing information - Web Hosting
Customers have the option of billing service on a monthly, quarterly, semiannual or they may receive an initial discount if they choose to pre-pay one year of service. We accept VISA, Master Card, American Express or Check payments. All payments for hosting or any other web services provided by Rebel Networks or its partners that are 14 days past due will be subject to suspension of services until payment in full is received.  Sites that are over 21 days past due will be charged a $19.95 reinstatement fee in addition to full balance due to reinstate the site.  Sites that exceed allowed transfer are required to upgrade with in 14 days (Site contacts will receive notices as to exceeding monthly transfer limits prior to exceeding transfer).  If site has not been upgraded within 14 days the site will be suspended until payment in full for the extra transfer has been paid or until account has been upgraded to a plan with the needed extra needed data transfer.  Sites that are suspended for more than 21 days will be charged a $19.95 reinstatement fee in addition to balance due to reinstate site.  Suspended sites will be deleted and all files will be removed from the Rebel Networks Network if left suspended for 31 days.  Site that are removed for past due balance of more than 31 days or sites that are removed for policy abuse issues are no eligible for any refund of service fees.

Credit Card Billing (Automated)
If an account has been signed up to pay by credit card our automated system will bill you card monthly, quarterly semiannual or annual unless you change the billing cycle in your control panel. If a credit card has been declined for any reason our system will attempt to bill the card again in 5 days. If an account has not received payment after 14 days it is subject to suspension. Rebel Networks is not responsible for any bank charges accrued by an overdrawn bank account or any extra bank fees. Sites that are Suspended for more than 7 days will be charged a $19.95 reinstatement fee in addition to balance due to reinstate site.  Suspended sites will be deleted and all files will be removed from the Rebel Networks Network if left suspended for 31 days.  Site that are removed for past due balance of more than 31 days or sites that are removed for any policy violation or abuse issues are not eligible for any refund of service fees.

Refund Policy
Each of our hosting plans carries a 30 day money back guarantee.  If you are not completely satisfied with our services within the first 30 days of your contract, you will be given a full refund of the contract amount excluding mandatory setup fees (if any), and applicable domain registration fees.  All cancellations must be forwarded to us via email to support@rebelnetworks.com or fax 416-907-4201.  Phone requests will not constitute acceptance of any cancellation.  If you are on a monthly price plan and are past your initial 30 days of service, there are no credits due. If you choose a yearly price plan and cancel your service after 30 days, you will receive a prorated credit for the service unused less a $35 contract cancellation fee.  If balance does not exceed $35.00 then there will no refund given.  This policy does not apply to any additional services such as shopping carts, overages, additional disk space, additional pop accounts, web design, secure server certificates, web promotion, web managing, domain registration, etc.
